Terms of Service
Read Vouch’s Terms and Conditions to understand the rules, responsibilities, and guidelines for using the platform.
Acceptance of Terms
Welcome to Vouch. By accessing or using the Vouch platform, website, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before proceeding.
If you do not agree to these Terms, you must not access or use our Services. Your continued use of the Services following any update to these Terms constitutes your acceptance of the revised Terms.
These Terms apply to all users of the Services, including senders (buyers), recipients, and visitors.
Definitions
The following terms have specific meanings throughout these Terms:
Vouch / We / Us / Our
Refers to the Vouch platform and the company operating it.
Sender / Buyer
A registered user who purchases a Vouch gift for a recipient.
Recipient
The individual who receives a Vouch gift via a unique link.
Voucher
A merchant-restricted virtual debit card issued to the recipient through our card issuance partner.
Digital Envelope
The interactive, AI-generated personalised experience the recipient accesses before the Voucher is revealed.
Security Code
A unique 4-character alphanumeric code generated at purchase that the sender shares separately with the recipient to unlock the Digital Envelope.
Eligibility & Accounts
Age Requirement
You must be at least 18 years old to purchase a Vouch. By using the Services, you represent that you meet this requirement.
Account Registration
To send a Vouch, you must create an account and provide accurate, current, and complete information. You agree to keep this information up to date.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@vouch.com if you suspect any unauthorised access.
Recipient Access
Recipients do not need an account to claim a Vouch but must enter the correct Security Code to unlock the Digital Envelope.
Purchasing a Vouch
The Gifting Flow
To purchase a Vouch, you select a participating brand or merchant category, choose a monetary value, personalise the Digital Envelope (theme and AI story prompts), and complete a secure checkout.
Pricing & Currency
All prices are displayed in the currency shown at checkout. You are responsible for any currency conversion fees charged by your card issuer.
Payment Processing
Payments are processed by our PCI-DSS-compliant payment provider (Stripe). Vouch does not store your full card number. By submitting a payment, you authorise us to charge the displayed amount to your selected payment method.
Order Confirmation
Following a successful purchase, you will receive an email confirmation. The Security Code will be displayed on the confirmation screen — you are responsible for sharing it with your intended recipient through a secure channel of your choice.
The Voucher
Nature of the Voucher
Each Vouch is a virtual debit card issued by our card-issuance partner. The card is a standard payment instrument that is programmatically restricted to authorised merchants or merchant categories (via Merchant Category Codes or specific Merchant IDs).
Merchant Restrictions
The Voucher will be declined at merchants outside the permitted whitelist. Vouch is not liable for a transaction being declined at an unauthorised merchant.
Validity & Expiry
Vouchers are valid for the period displayed at purchase. After expiry, any remaining balance may be forfeited in accordance with applicable law and the terms of our card-issuance partner.
No Cash Value
The Voucher cannot be exchanged for cash, transferred to a bank account, or redeemed for cash at any point unless required by law.
Balance
The value loaded onto the Voucher is the amount paid at checkout. Vouch does not charge fees against the Voucher balance during the validity period.
Claiming & the Security Code
Upon receiving the gift link, the recipient must enter the correct Security Code to unlock the Digital Envelope and access the Voucher. This two-factor mechanism prevents anyone who intercepts the link alone from accessing the gift.
Sender Responsibility
The Security Code is generated at purchase and displayed only to the sender. You are solely responsible for sharing it securely with your intended recipient. Vouch does not transmit the Security Code on your behalf.
Lost or Compromised Codes
If the Security Code or gift link is shared with or intercepted by an unintended party, Vouch cannot reverse a valid claim. Contact support@vouch.com as soon as possible if you believe your gift has been compromised.
AI-Generated Content
The personalised story and visual content of the Digital Envelope (the "Story") is generated by a third-party generative AI provider based on the prompts and occasion details you supply.
Acceptable Use of Prompts
You must not submit prompts that contain or request content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable. Vouch reserves the right to refuse or remove content that violates these standards.
No Guarantee of Output
AI-generated content is non-deterministic. Vouch cannot guarantee any specific creative output. If you are dissatisfied with a generated Story, you may regenerate it before completing the purchase.
Content Ownership
You grant Vouch a non-exclusive licence to use your prompts solely to generate the Story for your gift. Vouch does not claim ownership of your prompt content.
Card Usage
Online Use
Card details (PAN and CVV) are displayed securely in-browser only after the recipient passes a re-authentication step (PIN entry). Vouch uses display components provided by our card-issuance partner so that raw card data never passes through Vouch servers.
In-Store Use
Because web browsers cannot directly provision cards into a device wallet, in-store payments are facilitated via a handoff to a compatible third-party tap-to-pay application (e.g., Curve or a partner payment app). Vouch provides the link and instructions; we are not responsible for the availability, functionality, or terms of any third-party app.
Declined Transactions
Transactions will be declined at merchants outside the permitted whitelist or if the Voucher has insufficient balance or has expired. Vouch is not liable for any loss, inconvenience, or cost resulting from a declined transaction.
Refunds & Cancellations
Vouch gifts are digital goods delivered immediately upon purchase. As a result, all sales are generally final once the gift is created and the Security Code has been displayed to the sender.
Unclaimed Gifts
If a gift has not been claimed (Security Code not yet entered) and you wish to cancel, please contact support@vouch.com within 14 days of purchase. Refund eligibility will be assessed on a case-by-case basis.
Claimed Gifts
Once a recipient has successfully entered the Security Code and accessed the Voucher, the gift is considered delivered and is not eligible for a refund, except as required by applicable consumer law.
Disputes
For any billing disputes, please contact support@vouch.com within 30 days of the transaction. Disputes raised with your card issuer (chargebacks) before contacting Vouch may limit our ability to assist.
Acceptable Use
You agree not to use the Services to:
Engage in any fraudulent, deceptive, or illegal activity, including purchasing Vouchers with stolen payment credentials.
Attempt to circumvent merchant restrictions or re-use card details beyond the intended gift redemption.
Reverse-engineer, decompile, or otherwise attempt to extract the source code of the platform.
Introduce malware, viruses, or any code intended to damage or disrupt the Services.
Harvest or scrape data from the platform without our express written consent.
Use the Services in any manner that could damage, disable, or impair Vouch's infrastructure or reputation.
Violate any applicable local, national, or international law or regulation.
Vouch reserves the right to suspend or terminate accounts that violate this section without prior notice.
Intellectual Property
All content, trademarks, logos, software, and other materials forming part of the Vouch platform are the intellectual property of Vouch or its licensors and are protected by applicable intellectual property laws.
Limited Licence
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your personal, non-commercial purposes.
Restrictions
You may not copy, modify, distribute, sell, or lease any part of the Services or the underlying software without our prior written consent.
Disclaimers & Liability
As-Is Basis
The Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Availability
While we target 99.9% availability of the card authorisation engine, we do not guarantee uninterrupted or error-free operation of the Services. Planned and unplanned maintenance may cause temporary unavailability.
Third-Party Failures
Vouch is not liable for any failure, outage, or error caused by third-party services including but not limited to our card-issuance partner, payment processor, AI provider, delivery networks, or third-party wallet applications.
Limitation of Liability
To the maximum extent permitted by applicable law, Vouch's total liability to you for any claim arising out of or in connection with these Terms or the Services shall not exceed the amount you paid for the specific Vouch gift giving rise to the claim.
In no event shall Vouch be liable for any indirect, incidental, special, consequential, or punitive damages, even if advised of the possibility of such damages.
Third-Party Services
The Services rely on and integrate with third-party providers, including:
A card-issuance partner (the issuer of the virtual debit card Voucher).
A PCI-DSS-compliant payment processor (Stripe) for checkout.
A generative AI provider for Digital Envelope story generation.
Email, WhatsApp, and other delivery networks for gift notifications.
Third-party tap-to-pay applications for in-store card usage.
Each third party has its own terms of service and privacy policy. Vouch does not control these services and is not responsible for their conduct, availability, or data practices. We encourage you to review their policies before use.
Changes to These Terms
We may update these Terms from time to time to reflect changes in our Services, applicable law, or business practices. The updated version will be indicated by a revised "Effective Date" at the bottom of this page.
For material changes, we will endeavour to provide reasonable notice (e.g., via email or a banner on the platform). Your continued use of the Services after the updated Terms take effect constitutes your acceptance of the revised Terms.
If you do not agree to the revised Terms, you must stop using the Services.
Governing Law
These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of [Jurisdiction].
Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of [Jurisdiction].
Note: This section is a placeholder and must be reviewed and completed by qualified legal counsel before these Terms are finalised.
